Terms of service

1. Who we are
These terms are between you and gods in business now EOOD (“we”, “us”), a company registered in Bulgaria. They cover the Mentor Factory application, this website and the services behind them (together, “the service”). By installing the app or using the service, you accept these terms.
2. What the service is
Mentor Factory is a desktop application, available today for macOS, that builds AI mentors from material you supply. It is a tool for applying methods and ideas. It is not professional advice. Mentor answers are generated by AI and can be wrong. Check anything that matters (legal, financial, medical, tax or otherwise) with a qualified person.
3. Your account
You sign in with a link we send to your email address. We hold no password for you. You are responsible for keeping that email account secure. You must be at least 18, or the age of majority where you live if that is higher, to buy a paid plan.
4. Plans, credits and payment
- Plans. Free, Mentor Guides and Mentor Workforce, at the prices on the pricing page. Subscriptions renew automatically until you cancel. Yearly plans are billed once a year.
- Credits. Usage is measured in credits. Every action costs the same number of credits on every plan. Included monthly credits roll over for one month, then expire. Extra credits are paid for up front and don’t expire while your account exists (see section 10).
- Spending order. Credits you pay for, meaning your plan’s monthly credits and the extra credits you buy (top-ups), are used first. Bonus credits are used last. Bonus credits are referral credits, the 10% extra on a top-up of €100 or more, and promotional credits.
- Refunds. Within 14 days of the first payment of a subscription, or of buying a top-up, you can withdraw and get a refund of what you paid, minus the share of the credits you paid for that you have already used. Bonus credits are never refunded or exchanged for money. After 14 days there is no refund; cancelling stops the next renewal. Renewals do not start a new 14-day period. At checkout you ask us to start immediately and confirm you understand this. The refund policy has the details.
- Merchant of record. Payments are processed by Stripe, which is the merchant of record for the transaction. Stripe’s terms apply to the payment. Stripe calculates, collects and pays the VAT due in your country, and refunds are issued through Stripe. Your card details go to Stripe and never reach us. Read Stripe’s buyer terms.
- Prices. Prices are shown without VAT. The total for your country is shown before you pay. Businesses with a valid EU VAT number are charged under the reverse-charge mechanism.
- Price changes. We tell you by email at least 30 days before a price change applies to your subscription.
- Failed payments. If a payment fails, paid features pause until it succeeds.
5. Free credits and referrals
- A device can receive the free plan’s credits, welcome and monthly, for up to three accounts. We may refuse free credits to accounts created to collect them, and flag such accounts for review. We don’t block networks.
- Each paying referral adds 3% of your plan’s monthly credits while the referred account stays subscribed, up to the maximum for your plan. Referral credits are a goodwill programme. We may change or end the programme, and we may withhold credits obtained through accounts created for that purpose.
6. Your material
- You keep what you own. We claim no rights in the documents, recordings or notes you supply.
- You’re responsible for your right to use it. Use material you own or are licensed to use, for your own purposes. Don’t use the service to reproduce or distribute someone else’s work.
- We don’t train on it and we don’t store it. The privacy policy describes exactly what is processed and what is kept.
7. Models
The service uses the AI model Mentor Factory provides. You can’t connect your own provider key. On paid plans that include Enhanced privacy mode, you may run chat on your own local model, on your computer or your own network. You are responsible for that model and its licence.
8. Acceptable use
Don’t use the service to break the law; to generate unlawful, defamatory or infringing material; to harass anyone; to access another person’s account or data; to probe or overload our systems; to get around metering or credits; to extract our prompts or generation method; or to resell the service without a written agreement. We may suspend an account that does.
9. Our intellectual property
The application, Framework Lock, the mentor generation method and its prompts, this website, and the Mentor Factory name belong to us or our licensors. Your licence to use the app is personal, non-exclusive and non-transferable.
10. Deleting your account
- You can delete your account only from inside the app (User settings → Account → Delete account), confirmed with a code sent to your email address.
- You choose: delete now, or at the end of the current billing period. If you choose the end of the period, the account works until then and you can cancel the deletion with “Keep my account”. Free accounts are deleted immediately.
- No refund is given for the remainder of the billing period, except a withdrawal within the 14 days described in the refund policy.
- Unused credits are forfeited on deletion, including purchased top-ups. If you are still within 14 days of the first payment of a subscription or of a top-up, withdraw before you delete and we refund you as the refund policy describes.
- After deletion we keep only: payment records held by Stripe, as tax law requires; money-related usage records that are no longer linked to you; and, only to stop repeat free trials, a scrambled fingerprint of your email address and the device’s free-trial record (it belongs to the device, is shared by all accounts on it, and holds no email address, conversations or mentors).
11. Suspension and termination by us
We may suspend or close an account that breaches these terms, or that the law requires us to close. If we close your account without cause, we refund the unused part of what you paid.
12. Availability and changes
We aim to keep the service available and report incidents on the status page. We may change, add or remove features. We won’t remove a paid feature you’re paying for without notice or an alternative. Upstream outages and maintenance are not a breach of these terms.
13. Liability
The service is provided as is. We don’t guarantee that mentor output is accurate or fit for a particular purpose. We are fully liable for harm we cause intentionally or through gross negligence, and for death or personal injury caused by our negligence. For anything else, our total liability to you is limited to what you paid us in the 12 months before the event. Nothing in these terms limits liability that the law does not allow us to limit, including your statutory rights as a consumer.
14. Law and disputes
Bulgarian law governs these terms. If you are a consumer living elsewhere in the EU, you keep the protection of your country’s mandatory consumer law and can bring a claim in the courts where you live. Otherwise, disputes go to the competent courts of Varna, Bulgaria. Please write to us first; we answer every complaint. You can also contact the Bulgarian Commission for Consumer Protection (kzp.bg) or the consumer authority in your country.
15. Changes to these terms
We announce material changes on this page and by email at least 30 days before they apply.
